If you are an immigrant to the United States, did you know that you are also required to have health insurance? Under the Affordable Care Act, US citizens, US Nationals, and lawfully present immigrants are required to have health insurance or be subject to tax penalties.
So what is a lawfully present immigrant?
• U.S. citizens and U.S. nationals.
• Lawful permanent residents or (“green card holders”).
• Lawful temporary residents.
• Persons fleeing persecution, including refugees and asylees.
• Other humanitarian immigrants, including those granted temporary protected status.
• Non-immigrant Status holders (including worker visas and student visas).
There are a few health insurance exemptions for immigrants but the laws are quite clear regarding status.
Health Insurance Eligibility for Immigrants
For lawfully present immigrants, you can apply through Covered California to see if you are eligible for coverage through the providers or for coverage through Medi-Cal.
For immigrants who fall under the not lawfully present status, you can apply for basic coverage through Medi-Cal. Private insurance may also be an option for you.
Families with mixed immigration statuses may also apply for health insurance coverage through Covered California. Whether you are not lawfully present but have family members who are, or if your family members are not lawfully present and you are, all can be considered for coverage.
Covered California will only ask for the status of the person(s) applying for coverage. This will be used only to confirm eligibility for health insurance. It will not influence immigration status.
